Cosalan said he will file the complaint as congressman representing the district. “This is already more than sufficient for the purpose of filing.”

National Artist Benedicto Cabrerra is supporting Cosalan in this battle.

Cosalan said he got the support of the national artist for visual arts in the case against the city as he is a resident of Barangay Cinco and he is also affected. “Bencab is still with us.”

Under the law, the Writ of Kalikasan issued by the Supreme Court empowers citizens to assert their rights for a better ecology.

Waterways and sources have also been contaminated by the garbage spill in Baguio City affecting Benguet residents.

The Kagaling River, which flows to other barangays like Nangalisan and San Pascual in Tuba, are also now contaminated affecting 332 families, while 295 households at Barangay Cinco are now left with no water supply and no safe water to drink.

Baguio Representative Bernardo Vergara has asked for the deferment of the Writ, citing solutions to the garbage mess at the Irisan dumpsite are underway.

Cosalan said lawyer Pablito Sanidad is going to head the legal team suing the City of Baguio.

All the affidavits and documents are now ready for filing by the end of the month. - (SunStar / by Ma. Elena Catajan)
