Writ of Kalikasan reaches supreme court

Supreme Court (SC) Justices are now ready to study the merit of the Writ of Kalikasan.

Lawyer Noe Villanueva said the SC officially received the petition Thursday. “We hope the SC Justices will take a look at the petition.”

Representative Ronald Cosalan personally brought the petition to the SC after furnishing a copy to Environment Secretary Ramon Paje.

Lawyers Pablito Sanidad, George Fukai III and Francisca Claver comprise the four-man legal team backing the filing of the Writ of Kalikasan with a slew of complainants.

Copies of the Writ were also given to City Hall of Baguio, giving all respondents starting from Mayor Mauricio Domogan and the entire council.

Villanueva said they are hoping for the issuance of a Temporary Environmental Protection Order (TEPO) for the city to halt all dumping of garbage at the Irisan dumpsite.

Villanueva said the filing of the Writ comes with a sense of urgency to protect the people of Tuba as well as those from the city from the danger posed by heaps of garbage at the dump. “We hope the SC Justices will do what is right.”

The Writ of Kalikasan gives teeth to the power of citizens to assert their rights for a better ecology.

Villanueva said the SC has three options, first, to summon all personalities before the SC to be heard; second, delegate the case to the Court of Appeals or make a decision at the soonest. (SunStar / by Ma. Elena Catajan)
